FORCASTR Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and FORCASTR ("we," "us," or "our"). By creating an account, accessing the platform, or using any of our services including the Prediction Market Terminal, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility and User Warranty

2.1 Age Requirements

You must be at least 18 years of age (or 21 years of age in jurisdictions where the legal age for entering into contracts or participating in prediction markets is higher) to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

2.2 Jurisdictional Compliance

YOU ARE SOLELY RESPONSIBLE for ensuring that your use of prediction market data and participation in prediction markets is legal in your specific country, state, province, or jurisdiction. Prediction market regulations vary significantly by location, and it is your obligation to:

• Verify that accessing prediction market data is permitted in your jurisdiction
• Comply with all applicable local, state, national, and international laws
• Understand and adhere to any restrictions on prediction market participation in your area
• Seek independent legal counsel if you are uncertain about the legality of using this Service

We make no representation that the Service is appropriate or available for use in all locations. Users accessing the Service from jurisdictions where such content is illegal do so at their own risk and are responsible for compliance with local laws.

2.3 Account Integrity

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information to keep it accurate and complete
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized access to or use of your account
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with any third party
• Not create multiple accounts or use the Service to circumvent access restrictions

3. Prohibited Activities and Acceptable Use

3.1 No Automated Extraction or Data Scraping

You expressly agree that you will NOT:

• Use any robot, spider, scraper, crawler, or other automated means to access the Service
• Extract, download, or harvest trade flow data, market data, or any proprietary information through automated tools
• Use any data mining, data extraction, or data gathering methods not explicitly provided through our user interface
• Create derivative databases or datasets from our proprietary data
• "Bulk download" historical trade data beyond normal human consumption patterns

3.2 No Commercial Redistribution

The trade flow data, analytics, and market intelligence provided through the Service are for your personal or internal business research use only. You may NOT:

• Sell, rent, lease, distribute, broadcast, or sublicense any data obtained from the Service
• Redistribute our proprietary data feeds to third parties
• Incorporate our data into any commercial product or service without explicit written permission
• Share your premium subscription access or paywalled content with unauthorized users
• Use the Service to provide services to third parties

3.3 No Reverse Engineering

You agree NOT to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
• Circumvent any paywalls, security measures, access controls, or encryption protocols
• Probe, scan, or test the vulnerability of our systems or networks
• Attempt to discover or replicate our proprietary algorithms, logic, or data processing methods

3.4 Market Manipulation Prohibition

You may NOT use the Service to:

• Engage in wash trading or other forms of market manipulation
• Conduct illegal trading activities
• Coordinate market manipulation schemes with other users
• Use our data in violation of any prediction market platform's terms of service

3.5 System Integrity

You agree NOT to:

• Introduce viruses, malware, or other malicious code
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Violate any applicable laws or regulations
• Harass, abuse, or harm other users through our community features
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

4. Intellectual Property Rights

All content, features, functionality, and intellectual property rights related to the Service, including but not limited to:

• Trade flow data and proprietary analytics
• AI-powered detection algorithms and signals
• User interface designs and visualizations
• Software code, databases, and technical architecture
• FORCASTR trademarks, logos, and branding

are owned by FORCASTR or our licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

5. Subscription and Payment Terms

5.1 Subscription Plans

FORCASTR offers both free and premium subscription tiers. Premium features may include enhanced data access, advanced analytics, real-time alerts, and priority support. Subscription details, pricing, and feature availability are subject to change with reasonable notice.

5.2 Payment Processing

All payments are processed through secure third-party payment processors (Stripe). By subscribing, you authorize us to charge your payment method for all fees associated with your subscription.

5.3 Billing and Renewal

Subscriptions automatically renew unless you cancel before the renewal date. You are responsible for all charges incurred under your account, including applicable taxes.

5.4 Refund Policy

Due to the digital nature of our Service and immediate access to premium data, refunds are generally not provided except as required by law or at our sole discretion.

5.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No partial refunds are provided for unused portions of subscription periods.

6. Data Accuracy and Disclaimer of Investment Advice

6.1 No Investment Advice

FORCASTR IS NOT A FINANCIAL ADVISOR. The Service provides market data, analytics, and informational tools for research purposes only. Nothing on this platform constitutes:

• Investment advice, recommendations, or endorsements
• Financial, legal, or tax advice
• An offer to buy or sell securities or prediction market contracts
• A guarantee of trading profits or outcomes

6.2 Data Accuracy

While we strive to provide accurate and timely data, we make no warranties regarding:

• The completeness, accuracy, or timeliness of market data
• The reliability of third-party data sources (including Kalshi)
• System uptime or data availability
• The performance of AI detection algorithms or trading signals

6.3 Trading Risks

Prediction market trading involves substantial risk of loss. You acknowledge that:

• Past performance does not guarantee future results
• You may lose your entire investment
• You should only trade with funds you can afford to lose
• You are solely responsible for your trading decisions

7. Privacy and Data Collection

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. We collect, use, and protect your personal information as described in the Privacy Policy.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• FORCASTR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim
• We are not responsible for trading losses, missed opportunities, or damages resulting from data inaccuracies, system downtime, or third-party failures

9. Indemnification

You agree to indemnify, defend, and hold harmless FORCASTR, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your use or misuse of the Service
• Your violation of any third-party rights or applicable laws
• Your trading activities on prediction market platforms

10. Termination

We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of subscription fees
• Extended inactivity

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, and limitations of liability) will remain in effect.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the Service. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

12.2 Arbitration Agreement

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

12.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and FORCASTR individually. To the fullest extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FORCASTR regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
